Free Tier II Threshold Checker

Do you need to file EPCRA Tier II? Enter your chemicals and the most you had on site at any one time. The checker flags Extremely Hazardous Substances (500 lb or their TPQ) and other hazardous chemicals (10,000 lb), and converts gallons to pounds. No account required.

Not on the Extremely Hazardous Substances list? It is checked against the 10,000 lb threshold for hazardous chemicals (anything with an SDS).

Tier II reporting thresholds

Hazardous chemicals

40 CFR 370.10

10,000 lb or more present at any one time. Covers any chemical that needs an SDS under OSHA’s Hazard Communication Standard.

Extremely Hazardous Substances

40 CFR 370.10

500 lb or the Threshold Planning Quantity, whichever is lower. Some EHS thresholds are as low as 1 lb.

Retail gas stations

40 CFR 370.10

75,000 gallons of gasoline and 100,000 gallons of diesel, when stored entirely underground at a retail station.

How to check whether you need to file Tier II

  1. 1

    List your chemicals

Enter each hazardous chemical or product at the facility, by name or CAS number. Extremely Hazardous Substances are recognized automatically.

  2. 2

    Enter the maximum amount

Use the largest amount on site at any one time during the year, totaled across all containers and locations at the facility, in pounds, kilograms, gallons, or liters.

  3. 3

    Add density for liquids

For gallons or liters, enter the specific gravity from SDS Section 9 so volume converts to pounds correctly. For an EHS in a mixture, enter its percentage.

  4. 4

    Read the result

Each chemical shows its weight in pounds, its threshold, and whether it is over, near, or under. Download the report as a PDF if you want to keep it.

Frequently asked questions

What are the Tier II reporting thresholds?+

Federally (40 CFR 370.10), you must report an OSHA hazardous chemical present at 10,000 pounds or more at any one time, and an Extremely Hazardous Substance (EHS) present at 500 pounds or its Threshold Planning Quantity (TPQ), whichever is lower. Retail gas stations have higher thresholds for gasoline (75,000 gallons) and diesel (100,000 gallons) stored entirely underground.

When is the Tier II report due?+

March 1 every year, covering the previous calendar year. It goes to your State Emergency Response Commission, your Local Emergency Planning Committee, and your local fire department, usually through your state’s online system or EPA’s Tier2 Submit.

How do I count a chemical that is in several containers or mixtures?+

Add up the maximum amount present at the facility at any one time, across all containers and locations. For an EHS in a mixture, count only the EHS portion (amount × its percentage). For other hazardous chemicals in a mixture, you can report the mixture as a whole or by component.

Do lead-acid batteries count for Tier II?+

Often, yes. Sulfuric acid is an EHS with a 500 lb Tier II threshold, and forklift or backup-power batteries can hold a lot of it. Count the sulfuric acid inside the batteries, from the battery’s SDS, toward the 500 lb threshold.

Are state thresholds different?+

Some are lower. California’s Hazardous Materials Business Plan program, for example, starts at 55 gallons of a liquid, 500 pounds of a solid, or 200 cubic feet of a compressed gas. Check your state’s rules; this tool uses the federal thresholds.

What is an Extremely Hazardous Substance (EHS)?+

A chemical on EPA’s EPCRA Section 302 list (40 CFR 355 Appendix A), such as ammonia, chlorine, sulfuric acid, nitric acid, formaldehyde, and hydrogen fluoride. Each has a Threshold Planning Quantity. Having an EHS at or above its TPQ also requires a one-time emergency planning notification to your SERC and LEPC within 60 days.

Is this tool free?+

Yes. Check as many chemicals as you need with no account and no payment. Your list is not stored unless you download the report.
