1. Acceptance of Terms

By accessing or using the Tellus EHS platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Tellus EHS provides an AI-powered chemical safety compliance platform that includes Safety Data Sheet (SDS) management, chemical inventory tracking, employee training management, compliance monitoring, label printing, PPE recommendations, and related tools designed to help businesses comply with OSHA HazCom standards (29 CFR 1910.1200).

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or organization may not maintain more than one free trial account

4. Subscription and Payment

• Paid plans are billed monthly or annually as selected at the time of purchase
• All fees are non-refundable except as required by applicable law
• We may change pricing with 30 days' notice; changes take effect at the start of your next billing cycle
• Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends

5. Your Data

You retain ownership of all data you upload to the Service, including Safety Data Sheets, chemical inventories, training records, and other company information. We do not claim ownership of your content.

• You grant us a limited license to process your data solely to provide the Service
• You are responsible for the accuracy and legality of the data you upload
• You can export your data at any time through the platform
• Upon account termination, we retain your data for 90 days before permanent deletion

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code or content
• Resell or redistribute the Service without our written consent

7. Disclaimer

Tellus EHS is a compliance management tool designed to assist with OSHA HazCom requirements. The Service does not constitute legal, safety, or regulatory advice. While we strive for accuracy in our AI-powered features (including SDS parsing, PPE recommendations, and training generation), you are ultimately responsible for verifying compliance with applicable regulations. We recommend consulting with qualified safety professionals for critical compliance decisions.

8. Limitation of Liability

To the maximum extent permitted by law, Tellus EHS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Termination

• You may cancel your subscription at any time through your account settings
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your right to use the Service ceases immediately
• Data retention after termination is governed by our Privacy Policy

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
